The Terms of Use prescribe the conditions and rules for End Users and refer to the use of the Website. By using the website, End Users declare that they agree with the General Terms and Conditions of Business and Use and agree to use the website www.agromoto.hr in accordance with them. The right to use the website is a personal right of the End User, and cannot be transferred in any way to other natural or legal persons, nor is any user authorized to register other natural or legal persons.
The company CHESI D.O.O. reserves the right at any time to modify or terminate any segment of the business, including, without limitation, the content, time of availability, as well as the equipment required to access or use the pages.

Www.agromoto.hr is the registered domain of the company CHESI D.O.O.
The user can send his inquiries and comments in writing, by post or e-mail, Whatsapp, Viber and Agromotoshop will send a written response by post or e-mail within the legal deadline.
Headquarters of CHESI D.O.O. is in Koprivnica, in the Republic of Croatia. Legal disputes that may arise as a result of the use of these Internet pages (unless otherwise stated in a separate contract) are under the jurisdiction of the court.
In the following text of the General Terms and Conditions, instead of the term End User, the term Customer will be used in a situation where the End User and CHESI D.O.O. concluded a Purchase Agreement.
Terms of use of the services of the website www.agromoto.hr (Agromotoshop)
As part of the registration, the Customer will be offered acceptance of these General Terms of Use, the acceptance of which is a prerequisite for using the services of the www.agromoto.hr website.
Agromotoshop invites the Customer to view the contents of the Confidentiality Statement.
Prices
Prices are expressed in Croatian kuna (HRK) and Euros (EUR), include VAT, and are valid for all payment methods at the time of purchase. All payments made until 31st of December 2022 will be charged in Croatian kuna (HRK). Since 1st of January 2023 all payments will be charged in EUR.
The price of goods is determined for each product individually. The process of entering the price on the page for each product is subject to multi-level control.
Shipping cost
The shipping cost depends on the total weight of the ordered parcel and on the country to which it is sent, and the delivery prices may vary according to changes in the courier services contract with the Seller.
Return of goods and termination of distance sales contracts
Only the Customer who concluded the Distance Contract in the manner described above has the right, without giving reasons, to unilaterally terminate the contract within 14 days. The period of 14 days begins to run from the day when the goods that are the subject of the contract are handed over to the Customer or a third person designated by the Customer, who is not the courier.
Before the expiration of the term for unilateral termination, the Customer is obliged to notify the Seller of his decision to terminate the contract by means of the Form for Unilateral Termination of the Contract, which can be filled out electronically and sent to the email address: info@agromoto.hr. Confirmation of receipt of notification of unilateral termination of the contract will be delivered by the Seller, without delay, by e-mail.
If the Customer unilaterally terminates the Agreement, the money received by the Seller from the Customer will be refunded, no later than within 14 days from the day the Seller receives the Request for unilateral termination of the Agreement from the Customer. The costs of returning the goods are paid by the Customer. Refunds will be made only after the goods have been returned to the Seller. The Customer is obliged to return the goods immediately, and no later than within 8 days from the day when he sent the decision on unilateral termination to the Seller. The Customer is responsible for any decrease in value of the goods resulting from the handling of the goods. If the spare part was mishandled without professional installation and if the part was damaged during installation, the Seller will not accept the complaint. If the product is returned defective, with major damages or without parts and documentation, and if they are not delivered within 8 days, it is considered that the Customer has not fulfilled his obligation to return the goods, and the Seller is not obliged to return the paid funds.
In other cases, the shipping cost of the returning parcel must be paid for by Customer or Seller, according to a mutual agreement between the Customer and Seller.
Every product (excluding universal parts) in the Agromotoshop store has a defined purpose i.e. a description in which it is clearly stated for which machine the part is to be used on/mounted on.
In case of wrongly ordered parts (different dimensions than required or parts that the Customer wants to use on/mount on a machine different than is stated in the product
description) the return parcel shipping cost is to be paid for by the Customer.
NOTICE ON HOW TO SUBMIT CUSTOMER COMPLAINTS AND LIABILITY FOR MATERIAL DEFECTS/COMPLAINTS
The Seller is responsible for the material defects of the products he sells on his website in accordance with the regulations of the Republic of Croatia, especially the Obligations Act. The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. When receiving the goods, checking the correctness of the order depends on the buyer, in the event of a visible lack of product when taking over the shipment, the buyer is not obliged to take over the delivered product, he can refuse the delivery, and he does not bear the costs of delivery for such a product. It is considered that the products that were duly received by the Customer had no visible defect. The Customer has the right to complain in relation to material defects in the deadlines and for the reasons prescribed by the provisions of the Law on Mandatory Deadlines.
Pursuant to Article 10 of the Customer Protection Act (Order Nov., No. 41/14), we inform Customers that they can express their dissatisfaction with the purchased product in several described ways. The Customer can send a written objection or complaint to the e-mail info@agromoto.hr.
The Customer has the right to a justified complaint and to return the goods in the following cases:
• delivery of goods that were not ordered
• delivery of goods that have a fault or damage
The Seller undertakes to respond to the written complaint within 15 days from the day of receipt of the written complaint. The Seller will consider the complaint valid if, after examining the product, he determines that it meets the conditions for a complaint in accordance with the Law on Obligations and the Law on Customer Protection. In this case, within 15 days of receiving a valid complaint, they will replace the product or return the entire amount paid with termination of the contract. If, on the other hand, it finds that the complaint is not valid, i.e. if it rejects the complaint due to any of the above mentioned reasons from the “Return of goods and termination of distance sales contracts” paragraph, it will inform the Customer about the same within 15 days from the day of receipt of the complaint.

According to a special regulation of the European Union, from February 15th, 2016, it will be possible to resolve disputes related to online purchases throughout the EU via the ODR platform, which you can access here:

This means that if you encounter a problem during an online purchase within the EU (defective product, inability to exchange a product, etc.), you can submit your complaint in a faster and simpler way at the above link. The platform can be used by both Customers and Sellers, and complaints can be submitted in any of the 23 official languages of the EU.
